These Terms & Conditions (“Terms”) govern access to and use of the Commuhnity platform and related websites, applications, and services (collectively, the “Service”) operated by Digiclap Technologies Private Limited (“Digiclap”, “we”, “us”, or “our”). By accessing or using the Service, you agree to these Terms.

This document is a starter policy for product launch and should be reviewed by legal counsel before relying on it for commercial contracts.

1. The Service

Commuhnity is a multi-tenant software platform that helps housing societies (RWAs) manage operations such as billing, notices, polls, complaints, visitors, documents, marketplace listings, and related resident services. Features may vary by plan, role, and society configuration.

2. Eligibility and accounts

  • You must provide accurate registration and profile information.
  • You are responsible for safeguarding login credentials and for activity under your account.
  • Society administrators are responsible for inviting or registering residents and assigning appropriate roles and flats.
  • We may suspend or terminate accounts that violate these Terms or pose a security risk.

3. Society data and roles

Each society’s data is intended to remain scoped to that society. Administrators and residents must only access data they are authorised to view. You must not attempt to access another society’s data, circumvent access controls, or misuse voting, billing, or complaint workflows.

4. Acceptable use

  • Do not upload unlawful, defamatory, or infringing content.
  • Do not interfere with the Service’s security, integrity, or availability.
  • Do not reverse engineer the Service except where applicable law permits.
  • Do not use the Service to send spam or unsolicited bulk messages outside legitimate society communications.

5. Subscriptions, fees, and taxes

Paid plans, if applicable, are billed according to the commercial terms agreed with Digiclap or shown at purchase. Fees are generally non-transferable. Applicable taxes may be charged as required by law. Non-payment may result in suspension of paid features.

6. Intellectual property

The Service, including software, branding, and documentation, is owned by Digiclap Technologies Private Limited or its licensors. You retain rights to content you upload (such as society notices or documents), and grant us a limited licence to host, process, and display that content solely to operate the Service.

7. Third-party services

The Service may integrate with third-party tools (for example payment gateways, messaging, or hosting providers). Those services are subject to their own terms. Digiclap is not responsible for third-party outages or policies outside our control.

8. Disclaimers

The Service is provided on an “as is” and “as available” basis. While we aim for reliable operations, we do not warrant uninterrupted or error-free service. Societies remain responsible for the accuracy of billing amounts, notices, poll configurations, and compliance with their bye-laws and applicable law.

9. Limitation of liability

To the maximum extent permitted by law, Digiclap Technologies Private Limited shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from use of the Service. Our aggregate liability for claims relating to the Service shall not exceed the fees paid to us for the Service in the twelve (12) months preceding the claim (or INR 5,000 if no fees were paid).

10. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or for operational/security reasons. Upon termination, your right to use the Service ends; certain provisions (including intellectual property, disclaimers, and liability limits) survive.

11. Governing law

These Terms are governed by the laws of India. Courts in India shall have exclusive jurisdiction, subject to any mandatory consumer protections that apply to you.
